It is the intent of the District to provide a free and appropriate public education to each student ensuring that students who are disabled within the definition of Section 504 of the Rehabilitation Act of 1973 are identified, evaluated and provided with appropriate educational services. Students may be disabled under Section 504 even though they may not be eligible for services pursuant to the Individuals with Disabilities Education Act (IDEA).
Section 504 of the Rehabilitation Act of 1973 (“Section 504”) is a federal civil rights law that prohibits discrimination against individuals with disabilities. Local Educational Agencies (LEAs), including school districts and charter schools, are required to provide a free appropriate public education (FAPE) to qualified students with disabilities. FAPE consists of regular or special education and related aids and services designed to meet the individual needs of students with disabilities as adequately as the needs of students without disabilities are met. The goal of Section 504 is to level the playing field, not to maximize potential.
